The Alberta Court of Appeal has released a landmark decision in Charkhandeh v. College of Dental Surgeons, significantly redefining the law of costs in professional discipline cases. The Court abandoned the Jinnah framework and rejected presumptions in the determination of costs. The decision provides new guidance on factors to consider regarding costs orders, as well as sanctioning.

Discussion topics include:

  • The Court’s new guidance for regulators seeking investigation or hearing costs
  • What is a regulator’s “infrastructure”?
  • New processes to track and account for expenses and costs
  • How much detail regulators should disclose
  • The Court’s interpretation of its role in reviewing sanctions and costs decisions
