Mediation

Mediation is a voluntary flexible, confidential process in which a neutral party - the mediator - helps the parties work towards a resolution of their choosing. Our team of mediators can provide alternatives to traditional litigation that allow your clients to resolve disputes quickly and efficiently without unnecessary cost.

Our mediation team has decades of legal experience spanning dozens of industries, and they have earned a reputation in the industry for their professionalism, creative thinking and problem-solving. Our lawyers have participated in hundreds of trials and Alternative Dispute Resolution processes as counsel, giving them valuable insight into how the judiciary thinks about and reacts to cases and providing an excellent reference for analyzing and evaluating disputes as a mediator.

Mediation has several benefits, including:

  • Flexibility: Mediation allows the parties to come up with a solution that is tailored to their specific needs and interests.
  • Control: Mediation gives the parties control over the outcome of the dispute, rather than leaving the decision in the hands of a judge, jury, or arbitrator.
  • Preservation of relationships: Mediation allows the parties to maintain a working relationship, which can be important in cases where the parties will continue to have to interact in the future.
  • Voluntary: Mediation is a voluntary process, the parties can choose to participate or not.
  • Empowerment: Mediation empowers the parties to take responsibility for resolving the dispute and to find a mutually acceptable solution.

Arbitration

Arbitration is a confidential process in which a neutral party - the arbitrator - hears evidence under oath and makes a binding decision on the issues in dispute. Arbitrators are typically chosen by the parties to the dispute, and the arbitration process is usually governed by a set of rules or laws that have been agreed upon in advance by the parties.

At Field Law, our arbitration team has been involved in resolving disputes in a variety of contexts, including commercial, employment and contractual disputes. Like mediation, it can be a faster and less expensive alternative to going to court, and it allows the parties to customize the process to their specific needs.

Arbitration has several benefits, including:

  • Flexibility: Arbitration allows the parties to customize the process to their specific needs.
  • Expertise: Arbitrators are often experts in the field related to the dispute, which can lead to a more informed decision.
  • Finality: Arbitration awards are typically final and binding, meaning that the parties are required to abide by the decision and there are limited opportunities for appeal.
