Malkit Atwal is a member of Field Law’s Business Law and Wills, Estates and Trusts Practice Groups in the firm’s Edmonton office.
Malkit advises business owners, professionals, financial institutions and charitable organizations on a variety of corporate law and governance matters. He regularly acts for physicians, dentists and other health care professionals in incorporating their practices, and advising them on legal matters pertinent to their practices and personal affairs.
Malkit also advises clients in all areas of estate planning, including in the preparation of wills, enduring power of attorneys, personal directives and trusts. Recognizing the importance of tailoring each estate plan to the client’s unique circumstances, Malkit takes an active interest in developing the right plan for each person and works closely with the client’s other trusted advisors in structuring and implementing unique and individualized estate plans.
Malkit also advises executors named in wills about their rights, duties and obligations and frequently assists executors in applying for and obtaining the appropriate grants of probate. He recognizes that an executor’s role in the estate administration process can be stressful and demanding, often requiring them to act during a time of great grief. He is sensitive to these challenges and works closely with executors throughout the process to ensure the efficient and timely administration of the estate.
Malkit has represented clients in contested estate matters, including will challenges, undue influence claims, family relief hearings and in removing trustees and executors. He has appeared before all levels of Court in Alberta and has participated in matters before the Court of Appeal of the Northwest Territories and at the Supreme Court of Canada.
Malkit is an executive member of the Canadian Bar Association’s Wills and Trusts section and is the Chair of the Canadian Bar Association’s Elder Law section.
